Terms of Service

These Terms apply to your use of the Nuva mobile application and website. Nuva is a personal journaling and self-reflection app. It is not medical, psychological, therapeutic, financial, legal, or other professional advice.

Please read these Terms of Service ("Terms") carefully before using Nuva ("Nuva", "we", "us", or "our"). By downloading, accessing, or using Nuva, you agree to these Terms. If you do not agree, do not use Nuva.

1. The Nuva service

Nuva helps you record moods, activities, notes, and reflections, and may present charts, statistics, recommendations, or relationship-based insights from the information you enter.

Nuva is designed as an offline-first app. Your journal entries, moods, activities, notes, and related insights are stored locally on your device and are not stored on Nuva servers.

2. No account

Nuva currently does not require an account, signup, login, waitlist, or email registration. You are responsible for controlling access to your device and local app data.

3. Local data, backups, and data loss

Because Nuva stores journal data locally on your device, you are responsible for maintaining your device, backups, exported files, and access credentials.

If you uninstall Nuva, clear app data, lose your device, disable backups, replace your device, or experience an operating system or hardware failure, your Nuva data may be permanently lost. We are not responsible for loss of locally stored data and may not be able to recover it.

Depending on your device settings, your local Nuva data may be included in device backups or cloud backups controlled by your device provider. Those backups are outside Nuva's control.

4. Diagnostics, crash reporting, and performance monitoring

Nuva may use third-party diagnostics, crash-reporting, and performance-monitoring services, currently Firebase Crashlytics and Firebase Performance Monitoring, to diagnose errors, improve app stability, measure performance, and maintain the service. Product analytics/event tracking is not currently implemented. These tools may collect technical, diagnostic, crash, and performance information as described in our Privacy Policy.

You agree not to intentionally submit sensitive personal content through support channels, logs, issue reports, or other communications unless necessary for your request.

5. Not medical or professional advice

Nuva is provided for personal journaling, mood tracking, activity tracking, and self-reflection only. Nuva does not provide medical, psychological, therapeutic, psychiatric, financial, legal, or other professional advice.

Any charts, statistics, recommendations, or insights shown by Nuva are informational only and may be incomplete, inaccurate, or not suitable for your circumstances. Do not rely on Nuva to diagnose, treat, prevent, or manage any health condition. If you need professional support, contact a qualified professional.

6. Your responsibilities

You agree to use Nuva only for lawful purposes and in accordance with these Terms. You must not:

  • reverse engineer, decompile, or attempt to extract the source code of Nuva except where allowed by law;
  • interfere with, damage, or disrupt Nuva or related systems;
  • use Nuva in a way that violates applicable law or the rights of others;
  • attempt to misuse analytics, crash-reporting, support, or website systems.

7. Intellectual property

Nuva, including its design, software, branding, text, graphics, and other materials, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer ownership of Nuva or any intellectual property rights to you.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Nuva for your personal, non-commercial use.

8. Updates and changes

We may update, modify, suspend, or discontinue Nuva or any part of it at any time. We may also release updates that add, change, or remove features. Some updates may be required for continued use of Nuva.

9. Third-party services

Nuva may rely on third-party services, software development kits, platforms, app stores, operating systems, or device features. Your use of those third-party services may be subject to separate terms and privacy policies. We are not responsible for third-party services that we do not control.

10. Disclaimer of warranties

Nuva is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, and uninterrupted or error-free operation.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from or related to your use of Nuva.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

12. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from claims, damages, liabilities, losses, and expenses arising from your misuse of Nuva, your violation of these Terms, or your violation of applicable law or third-party rights.

13. Termination

You may stop using Nuva at any time. We may suspend or terminate access to Nuva or related services if we believe you have violated these Terms or applicable law.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the effective date above. Continued use of Nuva after updated Terms become effective means you accept the updated Terms.
